LIMITED ONE-YEAR WARRANTY
Heritage Flag & Supply (HFS), warrants to the first purchaser of its products ("Buyer") that its products will be free from defects in material and workmanship under normal use and service for a period of one year from the date of shipment by HFS. This warranty does not cover finishes, halyards, or flags, nor does it cover normal wear and tear, defects caused by improper installation, overloading, accident, misuse, neglect, or alteration or modification unless the alteration or modification has been approved, in writing, by HFS. Buyer acknowledges that all products offered by HFS are component parts only and therefore, the design and engineering of the application of these products is the responsibility of Buyer.
If any failure to conform to this warranty appears and written notice of such failure is given to HFS within the one year warranty period, HFS shall, at its sole discretion, repair or replace the nonconforming product. Repair or replacement by HFS is the Buyer's sole remedy in the event of a failure of the products to conform to this warranty. Specifically excluded from this warranty is the cost of labor required to remove, replace or reinstall the nonconforming product. No product shall be returned without the prior approval of HFS and upon such approval must be shipped postage prepaid by the buyer.
THE FOREGOING WARRANTY IS EXCLUSIVE AND HFS MAKES NO OTHER EXPRESS WARRANTY.
TO THE FULL EXTENT PERMITTED BY LAW, HFS EXPRESSLY DISCLAIMS ALL IMPLIED WARRANTIES INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. TO THE EXTENT ANY IMPLIED WARRANTIES CANNOT BE DISCLAIMED BY APPLICABLE STATE OR FEDERAL LAW, SUCH IMPLIED WARRANTIES ARE LIMITED TO THE ONE YEAR DURATION OF THE EXPRESS WARRANTY ABOVE. IN NO EVENT SHALL HFS BE LIABLE OR RESPONSIBLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL OR SPECIAL DAMAGES. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS OR THE EXCLUSION OR LIMITATION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY TO YOU. THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS AND YOU MAY ALSO HAVE OTHER RIGHTS WHICH MAY VARY FROM STATE TO STATE.
